Terms & Conditions

THESE TERMS AND CONDITIONS (“TERMS AND CONDITIONS”) SET OUT THE BASIS ON WHICH YOU CAN PARTICIPATE IN THE PROMOTION (“PROMOTION”). BY ENTERING THE PROMOTION, YOU ACCEPT THESE TERMS AND CONDITIONS IN FULL. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, YOU SHOULD NOT ENTER THE PROMOTION AND YOU WILL NOT BE ELIGIBLE TO WIN THE PRIZE. THESE TERMS AND CONDITIONS FORM A BINDING LEGAL AGREEMENT BETWEEN YOU AND THE PROMOTER (DEFINED BELOW) WITH RESPECT TO THE PROMOTION.

The Promotion
1. The Promotion is for participants to earn experience points (“XP”) in accordance with the provisions set out in clause 4. Accumulated XP may contribute toward eligibility for the award of tickets (the “Prize”). For Prize details, see clause 6.
2. The Promotion is in no way sponsored, endorsed, administered by, or associated with any social media platform, and relevant social media platforms shall have no responsibility to any entrants or participants.
How to enter
1. The promotion will run from 27/07/2025 (the "Opening Date") to Midnight (CET) 01/09/2025. (the "Closing Date") inclusive (the “Promotion Period”).
2. The first entry period for the Promotion will run from [DATE] (the "Opening Date") to Midnight (CET) [DATE]. Thereafter, entry periods for any future draws will be announced by the Promoter via its social media platform(s) (“Entry Periods”).
3. All Promotion entries must be received by the Promoter during the relevant Entry Period in order to be eligible for the applicable prize draw. Entries received after the conclusion of the relevant Entry Period shall not be included in that prize draw. However, all valid entries received during a relevant Entry Period which are not selected as winners shall remain eligible for subsequent draws, provided that such entries are received within the overall Promotion Period. Any entries received outside the Promotion Period shall be deemed invalid and shall not be included in any prize draw.
Entrant Requirements
1. In order to enter the Promotion, an individual must either (i) duly signed up for the waiting list for the forthcoming ComAve mobile application and have received an invitation email containing a referral link from the Promoter; or (ii) have clicked on a designated promotional post and successfully signed up for the forthcoming ComAve mobile application via the official waiting list.
2. Individuals who have already signed up for the forthcoming ComAve mobile application shall receive, via email, a unique referral link (“Referral Link”) directing recipients to a designated landing page. Individuals who register for the ComAve mobile application through the promotional post shall receive their Referral Link upon successful completion of the sign-up process. Entrants shall be permitted to share the Referral Link solely with individual natural persons. Corporations, companies, partnerships, societies, associations, and any other form of legal person or entity are expressly excluded from participation as referrals and shall not qualify for the purposes of this competition.
3. Each entrant must refer individual natural persons to the ComAve platform using their Referral Link. A referral shall only be deemed valid where the referred individual (the “Referral”) accesses the platform through the Referral Link and successfully completes the creation of a valid account on the ComAve platform, including, without limitation, confirmation of their email address and submission of all required registration data.
4. For the purposes of this competition, a “valid referral” shall mean a referral through which a new individual user accesses the platform using the entrant’s Referral Link and completes the account creation process as stipulated in Clause 4.3. The Promoter shall be solely responsible for verifying the validity of all referrals, including the confirmation of onboarding requirements and submitted contact details. No entry into the prize draw shall be recognised in relation to incomplete registrations, unverified information, or mere clicks on the landing page that do not result in a fully validated account.
5. In order to be eligible for entry into any prize draw conducted pursuant to this Promotion, each entrant must have made a minimum of one (1) valid referral in accordance with Clauses 4.3 and 4.4.
6. Subject always to the Promoter's successful validation of all referred individuals in accordance with Clause 4.4:

(a) entrants who make a minimum of one (1) and no more than three (3) valid referrals shall be eligible for entry into a prize draw for general admission tickets; and

(b) entrants who make four (4) or more valid referrals shall be eligible for entry into a prize draw for VIP tickets.

Eligibility for either prize draw shall be strictly conditional upon compliance with all entry requirements set out in these terms and conditions and shall be determined solely at the Promoter’s discretion.
The Promoter shall notify entrants whose referrals have been successfully validated and whose entry into the prize draw has therefore been confirmed. Entrants whose referrals fail to meet the validation criteria shall not be eligible to participate in the draw and shall be notified accordingly.
Only one (1) entry is permitted by each individual entrant.
The Promoter accepts no responsibility and shall bear no liability for any entries or referral links that are lost, mislaid, corrupted, delayed, or otherwise not processed due to technical errors or malfunctions of any kind, including but not limited to system failure, server downtime, network issues, software or hardware defects, or data loss.
Any costs incurred in submitting an entry shall be the responsibility of the entrant and will not be reimbursed.

Eligibility
1. The Promotion is only open to European Economic Area and UK residents aged 18 years or over, except:
  1. employees of the Promoter or its holding or subsidiary companies;
  2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration;
  3. employees or agents of the Club; or
  4. members of the immediate families or households of (a) (b) and (c) above.
2. In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Promotion.
3. The Promoter will not accept Promotion entries that are:
  1. automatically generated by computer or created by artificial intelligence;
  2. completed by third parties or in bulk; or
  3. incomplete.
4. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
5. The Promoter reserves all rights to disqualify an entrant if the entrant’s conduct is contrary to the spirit or intention of the prize Promotion.
The prize
1. Entrants who have provided a minimum of one (1) and no more than three (3) valid Referrals in accordance with Clause 4 shall be eligible to be entered into a prize draw for the opportunity to win one (1) general admission matchday ticket to attend a football match as published in the relevant promotional post (the “Prize”).
2. Entrants who have provided a minimum of four (4) valid Referrals shall be eligible to be entered into a separate prize draw for the opportunity to win one (1) VIP matchday ticket to attend a football match as published in the relevant promotional post (also a “Prize”).
3. Each Prize consists solely of either one (1) general admission matchday ticket or one (1) VIP matchday ticket, as applicable. The Prize expressly excludes any and all additional costs, charges, or expenses incurred by the winner, including but not limited to transportation to and from the stadium, accommodation, meals, beverages, purchases made at or in connection with the stadium or event, insurance, taxes, fees, and any other incidental costs. All such excluded costs and expenses shall be the sole responsibility of the winner. The Promoter shall not be liable for, nor shall it reimburse, any such costs incurred in connection with the Prize.
4. Announcements relating to the Prize, shall be published via the Promoter’s official social media channels.
5. Each Prize is non-transferable and cannot be exchanged.
6. Where it emerges after the Prize has been awarded that the entrant was in breach of these terms and conditions, the Promoter reserves the right to withdraw the Prize from that winner and they will not be entitled to any further reward or remuneration. The Promoter reserves the right to exclude individuals who breach our terms and conditions from entering future Draws or Promotions (including for any other club or third party).
Winner Announcement
1. Upon the conclusion of the Entry Period, all entrants who have submitted a minimum of one (1) and no more than three (3) valid Referrals in accordance with Clause 4 shall be eligible for selection in the prize draw for a general admission matchday ticket (the “General Admission Draw”). The winner of the general admission Prize shall be selected by means of an automated random draw (the “Draw”), which shall be conducted on the day immediately following the end of the Entry Period.
2. Following the General Admission Draw, all entrants who have submitted a minimum of four (4) valid Referrals in accordance with Clause 4 shall be eligible for selection in the prize draw for a VIP matchday ticket (the “VIP Draw”). The winner of the VIP Prize shall likewise be selected by means of an automated random draw, conducted on the day immediately following the end of the Entry Period.
3. In the event that no entrants have submitted at least four (4) valid Referrals by the close of the Entry Period, all entrants who have submitted at least one (1) valid Referral shall be eligible for inclusion in the VIP Draw.
4. One (1) Draw shall take place in respect of each Prize category, namely one (1) General Admission Draw and, subject to eligibility as set out in Clause 7.1, one (1) VIP Draw.
5. In the event that the winner has not claimed the Prize within the stipulated timeframe for any reason, or is disqualified in accordance with these Terms and Conditions, the Prize shall be awarded to an alternative winner, selected at random by the Promoter from the remaining eligible entries.
6. Winning entrants will be contacted via email it registered during onboarding registration of ComAve App. The entrant will be contacted once by or on behalf of the Promoter, and no follow up message will be sent. As part of the message, the entrant will be asked to confirm their full name and email address. The Promoter reserves the right to verify the eligibility of the winning entrant, including but not limited to requesting valid proof of residence to confirm that the winner is a resident of an eligible territory.
7. Failure to provide the requested documentation within the timeframe specified by the Promoter may result in disqualification at the Promoter’s sole discretion. In such an event, the Promoter reserves the right to award the Prize to an alternative winner (in accordance with clause 7.5). Promoter shall not be liable in any way for any disqualification resulting from a winner’s failure to comply with the provisions of this clause
8. The Promoter will make all reasonable efforts to contact the winner and if the winner cannot be contacted or is not available, or has not claimed their prize within 48 hours being contacted, the entrant will forfeit the Prize. The prize may not be claimed by a third party on your behalf.
9. The Promoter does not accept any responsibility if you are not able to take up the prize.
10. Once a Draw has taken place, the Promoter will announce a new Prize and Entry Period at a later date during the Season. Entrants will need to enter again to be eligible to win any future Prize. All previous entries will not be valid for future Draws.
11. Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.
12. Prize is provided by the Club and timings and delivery of the Prize will be communicated to the winner as soon as reasonably practicable. The date and timings of the Club’s Match are subject to change due to decisions made by the Club, its operational arrangements, broadcast scheduling, or other circumstances beyond the control of the Promoter. The Promoter reserves the right to substitute the Prize (or any part thereof) with an alternative prize of equal or greater value if circumstances beyond its control make it necessary to do so. The Promoter shall be obliged to notify the Club of the winner’s details for the purposes of Prize fulfilment. The Club shall have the right, in its sole and absolute discretion, to disqualify any winner or to withhold the Prize, including but not limited to circumstances where the winner is found to be ineligible or in breach of any applicable terms, conditions, or policies of the Club.
Winners
1. The decision of the Promoter is final and no correspondence or discussion will be entered into.
2. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the name winners and town of each winner following each Draw.
3. If you object to any or all of your name and town being published or made available, please contact the Promoter. Where you object, the Promoter will not publish your details but will still make these available to any relevant authority on request where required by law.
Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

Data protection and publicity
1. The Promoter will only process your personal information as set out in the privacy policy of the Promoter (available at: www.comave.com/en).
2. Your personal information is collected for the purpose of allowing you to participate in the Promotion, organizing the Draw and awarding the Prize. Failure to provide this information will make it impossible to participate in the Promotion or receive the Prize. We will use winners personal information to inform you about our promotions , products services and Promotions.
3. Your information is exclusively intended for the Promoter and third-party service providers processing data on the Promoter’s behalf (in particular, during the Draw or delivery of the Prize).
4. Your information will be retained for one year from the Closing Date. Entrants have the right to request from the Promoter access to and rectification or erasure of personal data or restriction of processing their data or to object to processing as well as the right to data portability, under the conditions and within the limits provided by applicable law.
5. These rights may be exercised by contacting the Promoter via email at dpo@comave.com.
6. Entrants that object to the processing of their data during the Promotion Period will not be allowed to participate in the Draw anymore.
7. Entrants also have the right to lodge a complaint with the CNIL (Commission nationale de l'informatique et des libertés) via its website (www.cnil.fr).
General
1. In the event of attempted or proven fraud or in case of breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the Promotion.
2. The Promoter shall not be held liable if, due to a force majeure event or any other event beyond its control, the Promotion is modified, shortened, extended, postponed or cancelled. Such changes will, however, be notified to entrants in advance by all appropriate means.
3. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts of their country of residence.

Winner Announcement
1. 2.2 Any entries received will be entered into a prize draw to be in with the chance to win a pair of tickets (either VIP or general admission) to a home match of the Club. See clause 6 for more details.

3. How to enter

3.1 The competition will run from 12:00pm on 7th August 2024 (the "Opening Date") to midnight (CET) on the last home game of the season for the Club (the "Closing Date") inclusive (the “Competition Period”).

3.2 The first entry period for the Competition will run from the Opening Date to midnight (CET) on 8th August 2024 and thereafter, the entry periods for any future draws will be announced by the Promoter via its social media platform(s) (“Entry Periods”).

3.3 All competition entries must be received by the Promoter during the relevant Entry Period. All competition entries received after the relevant Entry Period shall not be included in the relevant Draw.

4. How to enter

4.1 To enter the competition, an entrant must follow the Promotor’s relevant social media page within the relevant Entry Period. The entrant must follow from their own personal page on the relevant social media platform. All entrants must enter on their own behalf and may not enter on behalf of anyone else. If the Promotor becomes aware that the person who played the competition was not the entrant themselves, the Promotor will disqualify this entrant and no prize will be due to any persons involved.

4.2 Only one entry is permitted by each individual entrant. No purchase necessary.

5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

5.3 The Promoter will not accept competition entries that are:
a. automatically generated by computer or created by artificial intelligence;
b. completed by third parties or in bulk; or
c. incomplete.

5.4There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

6. The Prize

6.1 The prize will always be tickets to a home match for the Club on a given day of the Season. The prizes will be announced via the Promotors social media platforms for VIP tickets or general admission tickets on a specified date (a “Prize”). The Prize does not include travel insurance, the cost of transfers to and from the relevant match, food and drink, spending money, tax or personal expenses. Any other costs incurred are the responsibility of the winner(s).

6.2 The Promoter reserves the right to announce a Prize at any time during the Competition Period along with the relevant Entry Period which will apply. The Promoter may also advertise the Prize via any other medium at its absolute discretion.

6.3 Each Prize is non-transferable and cannot be exchanged.

6.4 Where, it emerges after the Prize has been awarded that the entrant was in breach of these terms and conditions, the Promoter reserves the right to withdraw the Prize from that winner and they will not be entitled to any further reward or remuneration. The Promoter reserves the right to exclude individuals who breach our terms and conditions from entering future Draws or competitions (including for any other club or third party).

7. Winner Announcement

7.1 Once the relevant Entry Period has closed, entrants from all of the valid entries will be selected by automated random draw (the “Draw”) for each Prize available. The Draw will take place no later than 5 days prior to the date of the relevant home match which forms part of the Prize.

7.2 Winning entrants will be contacted via direct message on the social media platform the entry is made. The entrant will be contacted once by or on behalf of the Promoter, and no follow up message will be sent. As part of the message, the entrant will be asked to confirm their full name and email address.

7.3 The Promoter will make all reasonable efforts to contact the winner and if the winner cannot be contacted or is not available, or has not claimed their prize within 24 hours being contacted, the entrant will forfeit the Prize. The prize may not be claimed by a third party on your behalf.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

7.5 Once a Draw has taken place, the Promoter will announce a new Prize and Entry Period at a later date during the Season. Entrants will need to enter again to be eligible to win any future Prize. All previous entries will not be valid for future Draws.

7.6 Where there has not been a winner, the Promoter reserves the right to announce a new Prize for the next Draw. 7.7 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

7.8 The Prize is supplied by the Club. The Promoter reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.

8. Winners

8.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

8.2 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the name winners and town of each winner following each Draw.

8.3 If you object to any or all of your name and town being published or made available, please contact the Promoter. Where you object, the Promoter will not publish your details but will still make these available to any relevant authority on request where required by law.

9. Limitation of Liability

10.3 Your information is exclusively intended for the Promoter and third-party service providers processing data on the Promoter’s behalf (in particular, during the Draw or delivery of the Prize).

10.4 Your information will be retained for one year from the Closing Date. Entrants have the right to request from the Promoter access to and rectification or erasure of personal data or restriction of processing their data or to object to processing as well as the right to data portability, under the conditions and within the limits provided by applicable law.

10.6 Entrants that object to the processing of their data during the Competition Period will not be allowed to participate in the Draw anymore.

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2 The Promoter shall not be held liable if, due to a force majeure event or any other event beyond its control, the competition is modified, shortened, extended, postponed or cancelled. Such changes will, however, be notified to entrants in advance by all appropriate means.

2. El Concurso
2.1 El concurso ofrece como premio entradas para el Atlético de Madrid (el «Club») durante la temporada 2024/25 (la «Temporada»).

2.2 Todas las participaciones que se reciban entrarán en un sorteo para ganar dos entradas (VIP o general) para un partido en casa del Club. Para más información, véase la cláusula 6.

2.3 El concurso no está patrocinado, avalado,gestionado ni asociado en modo alguno a ninguna plataforma de redes sociales. Las plataformas de redes sociales implicadas no asumen responsabilidad alguna frente a los participantes o concursantes.

3. Como Participar

3.1 El concurso estará vigente desde las 12:00 horas del 13 de agosto de 2024 (la «Fecha de inicio») hasta la medianoche (CET) del último partido en casa de la temporada del Club (la «Fecha de cierre»), ambos inclusive (el «Periodo del concurso»).

3.2 El primer periodo de participación en el Concurso se extenderá desde la Fecha de inicio hasta la medianoche (CET) del 21 de agosto de 2024 y, a partir de entonces, los periodos de participación para cualquier sorteo futuro serán anunciados por el Organizador a través de sus redes sociales («Periodos de participación»).

3.3 El Organizador debe recibir todas las participaciones durante el correspondiente Periodo de participación. Cualquier participación recibida fuera del plazo correspondiente no será incluida en el sorteo respectivo.

4. Como Participar

4.1 Para participar en el concurso, el usuario deberá seguir la página del Organizador en lared social correspondiente durante el Periodo de participación aplicable. La participación debe realizarse desde un perfil personal perteneciente al propio usuario. Cada persona deberá participar a título individual, quedando prohibida la participación en nombre de terceros. En caso de que el Organizador detecte que la persona que ha participado no coincide con el titular de la cuenta desde la cual se realizó la participación, dicha participación será descalificada y no se otorgará ningún premio a las personas implicadas.

4.2 Solo se permite una participación por persona. No es necesario realizar ninguna compra.

4.3 El Organizador se reserva el derecho de ofrecer incentivos de participación adicionalesdurante la duración del Concurso. 5. Requisitos de elegibilidad

b. empleados de agencias o proveedores del organizador o de sus sociedades de cartera o filiales, que esten profesionalmente vinculados al concurso o su administracion
c. empleados o representantes del club;
d. familiares directos o personas que cobvivan con cualquiera de los anteriores

5.2 Al participar, el usuario confirma que cumple con los requisitos exigidos para optar al premio. El Organizador podrá solicitarle que demuestre que cumple los requisitos para participar en el concurso.

5.3 El Organizador no admitirá participaciones que
a. hayan sido generadas automáticamente por sistemas informáticos o IA;
b. se hayan realizado a través de terceros o de forma masiva;
c. estén incompletas

5.4Solo se permitirá una participación por persona. No se aceptarán participaciones conjuntas ni en representación de terceros

5.5 El Organizador se reserva el derecho de descalificar a cualquier participante cuyo comportamiento resulte contrario al espíritu del concurso.

6. The Premio

6.1 El premio siempre consistirá en entradas para un partido que el Club juegue en casa en una fecha determinada de la temporada. Los premios se anunciarán a través de las plataformas de redes sociales del Organizador para las entradas VIP o generales en una fecha determinada (un «Premio»). El Premio no incluye seguro de viaje, el coste de los traslados hacia y desde el partido, comida y bebida, dinero para gastos, impuestos (excepto aquellos que sean estrictamente responsabilidad del Organizador por ley) ni gastos personales. Cualquier otro gasto derivado correrá a cargo del ganador

6.2 El Organizador se reserva el derecho de anunciar un Premio en cualquier momento durante el Periodo del concurso, así como el Periodo de participación correspondiente. Asimismo, podrá promocionar el Premio a través de cualquier otro medio, a su entera discreción.

6.3 Los Premios son intransferibles y no podrán ser canjeados por su valor en efectivoni por otros productos

6.4 Si, una vez entregado el Premio, se comprobase que el ganador ha incumplido laspresentes bases legales, el Organizador se reserva el derecho de retirárselo sin que el ganador tenga derecho a compensación alguna. Asimismo, podrá excluir a dicha persona de futuros concursos o sorteos, incluyendo los relacionados con otros clubes o terceros.

7. Regimen Fiscal

7.1 De conformidad con la Ley del Impuesto sobre la Renta de las Personas Físicas (IRPF), el Organizador está obligado a realizar una retención a cuenta del IRPF del ganador, siempre que el valor del premio (incluido el IVA) sea superior a 300 euros

7.2 El participante ganador deberá confirmar sus datos personales el día de la entrega del premio y presentar su documento nacional de identidad o tarjeta de residencia. Para que se pueda efectuar laretención mencionada en el punto anterior, el ganador deberá firmar un justificante de recepción del premio y entregar una copia de su documento de identidad. En caso contrario, perderá el derecho a recibir el Premio.

7.3 La cumplimentación de los datos personales y fiscales de los ganadores necesarios para la entrega de los premios es obligatoria. Por tanto, la falta de alguno de estos datos supondrá la pérdida del derecho al premio obtenido. El tratamiento de dichos datos por parte del Organizador se realizará conforme a la legislación vigente y a lo dispuesto en la cláusula 11 del presente documento y en la Política de privacidad del Organizador

7.4 De conformidad con la normativa española, el Organizador abonará el impuesto sobre actividades de juego correspondiente.

8. Anuncio de los ganadores

8.1 Una vez finalizado cada Periodo de participación, se realizará un sorteo automático y aleatorio (en adelante, el «Sorteo») entre todas las participaciones válidas para seleccionar al ganador de cada Premio. El Sorteo se celebrará a más tardar 5 días antes de la fecha del partido en casa correspondiente que forme parte del Premio.

8.2 El Organizador se pondrá en contacto conlos ganadores mediante un mensaje directo en la red social a través de la cual participaron. El Organizador o un representante autorizado solo se pondrá en contacto con el participante una vez y no enviará ningún mensaje de seguimiento. En dicho mensaje, se pedirá al participante que confirme su nombre completo y dirección de correo electrónico

8.3 El Organizador hará todo lo razonablemente posible por contactar con el ganador. Si el ganador no responde en un plazo de 24 horas, no puede ser localizado o no reclama su premio, perderá su derecho al mismo. El premio no podrá ser reclamado por terceros en su nombre

8.4 El Organizador no se hace responsable siel ganador no puede hacer uso del premio.

8.5 Tras cada Sorteo, el Organizador anunciará un nuevo Premio y Periodo de participación en una fecha posterior durante la Temporada. Para optar a futuros Premios, los participantes tendrán que participar de nuevo, ya que las inscripciones anteriores no serán válidas.

9. Ganadores

9.1 La decisión del Organizador será definitiva y no se aceptarán reclamaciones ni correspondencia al respecto.

9.2 El Organizador deberá publicar o poner a disposición de los participantes información que acredite que se ha entregado un premio válido. Para ello, se publicará el nombre y localidad del ganador después de cada Sorteo, siempre y cuando exista un consentimiento válido e inequívoco por su parte. El ganador deberá firmar un formulario de consentimiento antes de recibir el premio, lo cual se entenderá como contraprestación justa por la cesión efectuada. El formulario loproporcionará el Organizador junto con la notificación de adjudicación del premio, y deberá devolverse debidamente cumplimentado en un plazo de 3 días. Si no se recibe respuesta en dicho plazo, se entenderá que el consentimiento no ha sido otorgado y no se procederá a publicación alguna.

9. Limitation of Liability

9.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

10. Data Protection and Publicity

10.1 The Promoter will only process your personal information as set out in the privacy policy of the Promoter (available at: www.comave.com/en).

10.2 Your personal information is collected for the purpose of allowing you to participate in the competition, organizing the Draw and awarding the Prize. Failure to provide this information will make it impossible to participate in the competition or receive the Prize. We will use winners personal information to inform you about our promotions , products services and competitions.

10.3 Your information is exclusively intended for the Promoter and third-party service providers processing data on the Promoter’s behalf (in particular, during the Draw or delivery of the Prize).

10.4 Your information will be retained for one year from the Closing Date. Entrants have the right to request from the Promoter access to and rectification or erasure of personal data or restriction of processing their data or to object to processing as well as the right to data portability, under the conditions and within the limits provided by applicable law.

10.6 Entrants that object to the processing of their data during the Competition Period will not be allowed to participate in the Draw anymore.

11. General

11.1 In the event of attempted or proven fraud or in case of breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the competition.

11.2 The Promoter shall not be held liable if, due to a force majeure event or any other event beyond its control, the competition is modified, shortened, extended, postponed or cancelled. Such changes will, however, be notified to entrants in advance by all appropriate means.

11.3 These Terms and Conditions shall be governed by and construed in accordance with the laws of France. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts of their country of residence.

2. The competition

2.1 The competition is to win tickets for Olympique Lyonnais, AS Monaco (the “Club”) during the football season 2024/25 (the “Season”).
‍
2.2 Any entries received will be entered into a prize draw to be in with the chance to win a pair of tickets (either VIP or general admission) to a home match of the Club. See clause 6 for more details.
‍
2.3 The competition is in no way sponsored, endorsed, administered by, or associated with any social media platform and relevant social media platforms shall have no responsibility to any entrants or participants.

3. How to enter

3.1 The competition will run from 12:00pm on 13th August 2024 (the "Opening Date") to midnight (CET) on the last home game of the season for the Club (the "Closing Date") inclusive (the “Competition Period”).

3.2 The first entry period for the Competition will run from the Opening Date to midnight (CET) on 21st August 2024 and thereafter, the entry periods for any future draws will be announced by the Promoter via its social media platform(s) (“Entry Periods”).
‍
3.3 All competition entries must be received by the Promoter during the relevant Entry Period. All competition entries received after the relevant Entry Period shall not be included in the relevant Draw.

4. Entrant Requirements

4.1 To enter the competition, an entrant must follow the Promotor’s relevant social media page within the relevant Entry Period. The entrant must follow from their own personal page on the relevant social media platform. All entrants must enter on their own behalf and may not enter on behalf of anyone else. If the Promotor becomes aware that the person who played the competition was not the entrant themselves, the Promotor will disqualify this entrant and no prize will be due to any persons involved.

4.2 Only one entry is permitted by each individual entrant. No purchase necessary.

4.3 The Promotor reserves the right to run bonus entry incentives throughout the duration of the Competition. These incentives will be made public through the relevant social media platform. Where the Promotor operates an incentive, the entry limit may change.

4.4 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any technical malfunction, systems, network, server, computer hardware or software failure of any kind.

4.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

5. Eligibility

The competition is only open to all residents in England and the same jurisdiction as the Club aged 18 years or over, except:
a. employees of the Promoter or its holding or subsidiary companies;
b. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration;
c. employees or agents of the Club or;
d. members of the immediate families or households of (a) (b) and (c) above.

5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

5.3 The Promoter will not accept competition entries that are:
a. automatically generated by computer or created by artificial intelligence;
b. completed by third parties or in bulk; or
c. incomplete.

5.4There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

5.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

6. The Prize

6.1 The prize will always be tickets to a home match for the Club on a given day of the Season. The prizes will be announced via the Promotors social media platforms for VIP tickets or general admission tickets on a specified date (a “Prize”). The Prize does not include travel insurance, the cost of transfers to and from the relevant match, food and drink, spending money, tax or personal expenses. Any other costs incurred are the responsibility of the winner(s).

6.2 The Promoter reserves the right to announce a Prize at any time during the Competition Period along with the relevant Entry Period which will apply. The Promoter may also advertise the Prize via any other medium at its absolute discretion.

6.3 Each Prize is non-transferable and cannot be exchanged.
‍
6.4 Where, it emerges after the Prize has been awarded that the entrant was in breach of these terms and conditions, the Promoter reserves the right to withdraw the Prize from that winner and they will not be entitled to any further reward or remuneration. The Promoter reserves the right to exclude individuals who breach our terms and conditions from entering future Draws or competitions (including for any other club or third party).

7. Winner Announcement

7.1 Once the relevant Entry Period has closed, entrants from all of the valid entries will be selected by automated random draw (the “Draw”) for each Prize available. The Draw will take place no later than 5 days prior to the date of the relevant home match which forms part of the Prize.

7.2 Winning entrants will be contacted via direct message on the social media platform the entry is made. The entrant will be contacted once by or on behalf of the Promoter, and no follow up message will be sent. As part of the message, the entrant will be asked to confirm their full name and email address.

7.3 The Promoter will make all reasonable efforts to contact the winner and if the winner cannot be contacted or is not available, or has not claimed their prize within 24 hours being contacted, the entrant will forfeit the Prize. The prize may not be claimed by a third party on your behalf.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

7.5 Once a Draw has taken place, the Promoter will announce a new Prize and Entry Period at a later date during the Season. Entrants will need to enter again to be eligible to win any future Prize. All previous entries will not be valid for future Draws.

7.6 Where there has not been a winner, the Promoter reserves the right to announce a new Prize for the next Draw. All entries from the completed Draw, and any previous Draws, where no winner was declared, will automatically be eligible for the next Draw. Entrants do not need to enter again in order to be eligible but are able to do so if they would like to increase their chances.

7.7 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

7.8 The Prize is supplied by the Club. The Promoter reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.

8. Winners

8.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

8.2 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the name winners and town of each winner following each Draw.
